Important Warning to Landlords: You Cannot Rent for 2 Years After Eviction

Important Warning to Landlords: You Cannot Rent for 2 Years After Eviction The Turkish Code of Obligations contains important regulations to ensure balance in tenant–landlord relations. One of these arrangements is related to the re-leasing of real estate properties that were evicted on grounds of need. According to Article 355 of the TCO: If the landlord evicted the tenant on the grounds of need, reconstruction or zoning, he cannot rent the vacated real estate to anyone other than the former tenant unless three years have passed unless there is a justified reason. In addition, Article 355/2 clearly regulates the right of the former tenant to file a claim for compensation against the landlord who has acted contrary to this rule. The Purpose of the Regulation The most basic purpose of this rule is to prevent landlords from abusing their right to eviction. While landlords who are really in need, that is, who will use the housing for themselves, their children or their parents, are protected, it is prevented from victimizing the tenant just for higher rental income. CEESS Global Review We emphasize at every opportunity that trust is the most important element in the real estate sector. It is critical for landlords to know the legal limits when using their rights, and for tenants to act aware of their rights, both for a peaceful tenancy relationship and for a sustainable environment of trust in the sector. 3 Important Reminders For Tenants  Question the Reason for the Eviction: If your landlord wants an eviction on the grounds of his “own need”, follow up whether he will really sit down. Do not forget the 2-Year Rule: after the eviction, the house cannot be rented to someone else for 2 years. Otherwise, your right to compensation arises. Resort to Legal Remedies: If your rights are violated, know that you have the right to file a lawsuit and be sure to keep the written documents.
