This document acts as an official confirmation to protect the rights of heirs and to ensure the correct distribution of assets.

This document, which is now called “Inheritance Decree”, is used exactly in this way in today's legal language, although it is expressed under a different name in the old language.

How to Obtain a Declaration of Inheritance?

There are two different ways to obtain a Declaration of Inheritance:

1. Application through the Civil Court of Peace

The first option to obtain a Declaration of Inheritance is to apply to the Civil Court of Peacewhere you are located. For this application, a petition is submitted to the court. After evaluating the application and making the necessary examinations, the court issues the certificate of inheritance (certificate of inheritance) to the person requesting it.
 

Documents Required for Inheritance Declaration

When applying for an Inheritance Declaration, some documents must be submitted to both the Civil Court of Peace and the Notary Public. Here are these documents:

  • Photocopy of Identity Card: Identity information of the applicant and heirs.
  • Population Record Sample: Population records of the deceased and the heirs.
  • Death Certificate: Official document confirming the death of the deceased person.
